Terms & Conditions


By accessing, browsing or placing an order via our website, Facebook page or wholesale agent, you agree to be bound by the associated terms, conditions, disclaimers and limitations of liability. (Terms and Conditions) gemibaby reserves the right to amend or update the Terms and Conditions at any time without providing notice. 

By using the website or purchasing via Facebook page or our wholesale agent, you acknowledge that you have read and understood the Terms & Conditions.


  • All efforts will be taken to process orders within 1-2 business days from the date the order is lodged.  Orders placed over a weekend/Public Holiday will not be processed until the next business day.
  • Readymade items will be posted within 3-5 days of completed purchase.
  • Custom ordered items have a current turnaround time of 3-4 weeks.  This does not include postage times.
  • All orders are subject to availability of stock and confirmation of the order price.


All colours of garments are reproduced as accurately as possible, however a slight variation may occur in colour and size specifications.  Colours may appear different via photos displayed on the website, Facebook or in catalogues due to computer picture resolution and individual monitor and printer settings.


All prices are listed in Australian Dollars.  All purchases and payments are final.  Payment must be paid via PayPal, EFT or Credit Card.  Please note purchases will not be released, or custom orders started until full payment has been made and cleared.  gemibaby holds no responsibility for actions made to and from third party website, including PayPal.


Please note gemibaby does not offer exchanges or refunds on any items unless they are proven faulty - this includes custom orders, incorrect purchases and changes of mind.  All exchange/refund requests need to be made in writing to sales@gemibaby.com.au within seven (7) days of purchase.  Product must be returned in its original packing material and must be in its original condition for review prior to agreeing to refund or exchange.  Where possible an exchange will be made or if this is not possible a refund will be made to the account your payment was originally made from.  If we find that the conditions of the returns policy have not been met (for example, if the product is not faulty) no refund or replacement will be made and we will return the item to you.


gemibaby uses Australia Post Pre Paid Satchels as standard which includes basic tracking.  Registered Post and Express Post are also available at your expense and highly recommended. gemibaby accepts no responsibility for lost or misplaced parcels once they have left our studio.

Once an order has been shipped it cannot be cancelled. Please note gemibaby does not offer exchanges or refunds in the event you change your mind. Shipping time may vary depending on your location so please allow 2 – 7 days for delivery.  gemibaby will not be responsible for any delays in delivery which are beyond their control.  If goods are not available or if there is a delay in delivery, gemibaby will notify customers within 3 business days.


All the above terms and conditions also apply to Wholesale customers with a few additions:-

  • All wholesale enquiries/orders must be made via our wholesale agent, Wholesale Baby at mail@wholesalebaby.com.au
  • All products are traded under the agreement that they are not to be sold (either retail or wholesale) on any internet auction site, group buying, blog site or social media site at any time.  If unsure please ask us.  Sites include EBay, Etsy, Made it, Amazon, Facebook, Google + etc.  Products MUST only be sold on your businesses retail website, in your Bricks and Mortar store or at your market stall. There are no exceptions to this condition.
  • All businesses interested in wholesaling gemibaby products must have a current ABN and complete a gemibaby Wholesale Account Application.  ALL accounts will be cash upfront – no exceptions.
  • A minimum initial order of $220 is required (minimum 12 hats). For subsequent orders the minimum amount thereafter will be $55 (minimum 3 hats).
  • A 25% deposit is required on all orders (unless otherwise agreed to in advance) prior to the commencement of order.  All orders are made to order and have an average turnaround time of two (2) weeks plus postage times.  Wholesale Orders will be given priority over general custom orders and will be completed in the order of deposit/payments being received.  Full payment must be received prior to dispatch of orders via the payment methods above.
  • From time to time, pre-orders will be taken for new fabric releases.  A 25% deposit must accompany any pre-orders to enable gemibaby to secure the necessary supplies in advance.  The turnaround time on these orders may vary anywhere from 2 weeks to several months, but will these will be made clear at the time of offering the pre-order.
  • Delivery fees will remain payable on all orders & amounts will be confirmed upon receipt of order details.  Deliveries will be made via Australia Post or a Courier depending on the best price.


All images, illustrations, designs, photographs and written materials that appear on our website, Facebook page or in catalogues are intellectual property of or licensed via a third party to gemibaby. Contents as they appear are copyright and/or trademarked to gemibaby and /or third party interest. You may not reproduce or modify contents as they appear on this site. We are not liable for any loss incurred in relation to your use of this website. Your use of this site is at your own risk. To the extent permitted by law, we exclude all liability for any loss or damage (including without limitation indirect, special, punitive or consequential loss or damage) arising from the use or reliance on this website whether or not caused by a negligent act or omission.


At gemibaby we respect your privacy. We only use your personal information to process your orders. We do not send you any unsolicited mail. All information is kept confidential. We do not pass on your information to any third party. Our checkout is SSL secure so you can have confidence in purchasing from us.
